GENERAL TERMS AND CONDITIONS OF WE CONSULT GMBH
we consult gmbh (hereinafter referred to as "WeCon") concludes contracts exclusively according to the following general terms and conditions:
1. Contracting Party / Type of Service
1.1 "Accommodation-provider": Is a natural or legal person who accommodates Guests against payment.
1.2 "Guest": Is a natural person who makes use of accommodation. The Guest is also the Contractual Partner.
1.3 The services offered by WeCon are the arrangement of accommodation-contracts between the Guest and the Accommodation-provider. The accommodation-contract itself is concluded directly between the Guest and the Accommodation-provider.
2. Conclusion of Contract
2.1 The Guest makes a booking request to WeCon, which can be done by email, online via we-rent-apartments.com or via other related websites. In any case, the booking is confirmed by sending a reservation confirmation and requesting a deposit. The arrangement-contract as well as the accommodation-contract shall be deemed concluded upon sending of the reservation confirmation.
2.2 However, the contracts are concluded under the condition that a deposit in the amount according to the booking (payment by credit card or bank transfer) is paid within five working days. If the deposit is not paid, the condition is not fulfilled and the contracts are not legally effective. The deposit is partial payment on the agreed fee.
3. Cancellations
3.1 If there are more than 14 days between the reservation confirmation and the date of arrival, the Guest can cancel free of charge. Cancellation within 14 days before the date of arrival is not possible. In this case, the agreed fee is due in full.
3.2 The Consumer Protection Act and the Distance Selling Act are applicable.
4. Prices
4.1 The prices shown are daily prices for the rental of the booked accommodation (including furniture), whereby the consumption of water, energy, etc. is included. The first day is from 16:00 p.m. on the day of arrival to 10:00 a.m. on the following day; each subsequent day is always until 10:00 a.m. on the following day. All obligatory additional services, which are not included in the daily price - such as final cleaning and local taxes - will be explicitly stated in the reservation confirmation.
4.2 Non-mandatory additional services requested by the customer and possibly offered by the Accommodation-provider - such as additional cleaning, additional bed linen, pets, baby beds, heating material, etc. - are not included in the daily price, but are also not stated in the reservation confirmation.
5. Service and Price Changes
5.1 Due to compelling external circumstances or force majeure, changes in prices or services may occur on the part of the Accommodation-provider. If due to compelling external circumstances or force majeure after the conclusion of the contract price or service changes occur, that are not merely minor, the Guest may withdraw from the contracts within three days after receipt of the notification free of charge. Payments already made will be refunded immediately. "Not merely minor" means the omission of a specific detail that makes the object in question stand out from others and makes it interesting for the Guest precisely because of this. Access restrictions, however, are expressly excluded from this.
5.2 The correction of obvious errors, e.g. due to printing and calculation errors, remains reserved.
6. Arrival and Departure, Shortening or Prolongation of the Stay
6.1 Arrival must be after 16:00 p.m. on the day of arrival, departure must be no later than 10:00 a.m. on the day of departure. Changes (e.g. later arrival or departure, extension or shortening of the stay) are only possible in agreement with WeCon and the Accommodation-provider. Without agreement with WeCon and the Accommodation-provider, the entire price according to the booking shall be due in any case, even if the Guest does not or not completely make use of the contractual services due to illness, traffic jam or other reasons for which the Accommodation-provider or WeCon are not responsible.
6.2 The Guest is responsible for compliance with passport, visa, customs, foreign exchange and health regulations. If the Guest is prevented from arriving for such reasons, this does not entitle the Guest to derive any legal consequences from this.
6.3 WeCon is available by telephone daily until 20:00 p.m. In case of later arrivals, the possibility to communicate with WeCon by phone is not guaranteed.
7. Dissolution of the Contract by WeCon
WeCon is entitled to cancel the contract in case of force majeure, pandemic, war, strike or similar important reasons. All payments made will be fully refunded to the Guest in this case.
8. Complaints, Compensation
8.1 Information and descriptions are given by WeCon to the best of its knowledge and belief, but without guarantee for correctness. In case of complaints the Guest has to contact either the Accommodation-provider directly or WeCon. Any defect or complaint must be reported immediately. Later complaints, which arrive only at departure or after departure, cannot be accepted.
8.2 If the accommodation is not in conformity with the contract, WeCon shall endeavor to provide the Guest with an equivalent substitute accommodation. If this is not possible within a period of 5 working days, WeCon will compensate the Guest for any reduction in value, if culpable conduct is involved.
8.3 If the Guest is a consumer, the (compensation-) liability of WeCon for slight negligence, with the exception of personal injury, is excluded. If the Guest is an entrepreneur, the liability of WeCon for slight and gross negligence is excluded.
9. Miscellaneous
9.1 With the conclusion of the contract, the consent to the data processing is given. The complete privacy policy can be viewed at the data privacy statement of WeCon.
9.2 The place of performance and jurisdiction for all legal disputes arising from the legal relationship between the Guest, WeCon and the Accommodation-provider shall be Zell am See. All legal relationships are exclusively subject to the provisions of Austrian Law.
9.3 Electronic declarations shall be deemed received if the party for whom they are intended can retrieve them under ordinary circumstances.

Data privacy statement
This statement declares how we process your data. This statement is addressed to clients, who used our services in the past, but also to future clients, our partners and their employees.
1. Internal data use
1.1 Purpose of the data use
We are processing your data for the following purposes:
- for the reason, administration and execution of our business relation with our clients
- to strengthen our current business relation, but also to install future relations and to inform clients about legal changes and our range of services
- in case of an order placement with the aim to execute our services
- for the execution of our booking process including payment handling
- for the client registration with authorities
In case we collect data directly from you, the supply of the data is voluntary. In case you do not provide us with data, we can not fulfil certain services.
2.2 Legal background of the data processing
If you are a potential client, we are only doing direct marketing via email or post, with your agreement on the basis of the law Art. 6 Abs. 1 of the “Datenschutzgrundverordnung” (DSGVO). If you are a client, we are processing your data, because it is necessary to fulfil our contract with you. In any way we are processing your data in your interest and on behalf of the reasons named in section 1.
3.3 Exchange of data
If it is necessary to transfer your data in order to execute services named in 1, we are sending your date to following recipients:
- IT- Services such as for marketing and payment including credit card data. We ensure hereby the use of industry standards regarding encryption.
- Administration and state authorities
- Insurance companies in case of damage
- Cooperation partners and legal consultancies
- Declared recipients on behalf the client
1.4 Length of back up
Usually we save your data till the end of our business relation. For marketing purposes we save your data as long you do not disagree with the storage of your data, which was initially collected by us with your acceptance.
1.5 Your rights
You are allowed to: check (i) if and which of your data is stored, (ii) to claim correction, addition or cancelation, if they are wrong or not correctly processed, (iii) to claim to stop the processing of your data or (iv) to dissent with your initial agreement with us that we are allowed to process your data, whereby the dissent does not affect the data processing done before your dissent, (v) to claim the possibility to transfer data, and (vi) if you are our client being able to know identity of third parties who work with your data and (vii) to file a complaint within data security authorities.
2. Third party data use
2.1. Social media sites
We maintain publicly accessible profiles on social networks. The individual social networks used by us can be found below.
Social networks such as Facebook, Twitter etc. can generally comprehensively analyse your user behaviour when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). By visiting our social media presences, numerous data protection-relevant processing operations are triggered. In detail:
If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected under certain circumstances if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.
With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. Provided you have an account with the respective social network, the interest-based advertising may be displayed on all devices on which you are or were logged in.
Please also note that we are not able to track all processing procedures on the social media portals. Depending on the provider, further processing procedures may therefore be carried out by the operators of the social media portals. 2.1.1 Legal basis
2.1.2 Person responsible and assertion of rights
Please note that despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing procedures of the social media portals. Our options are largely determined by the corporate policy of the respective provider.
2.1.3 Storage period
The data collected directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected.
We have no influence on the storage period of your data, which is stored by the operators of the social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

We have a profile on Facebook. The provider of this service is Facebook Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. According to Facebook, the data collected is also transferred to the USA and other third countries.
We have entered into a joint processing agreement (Controller Addendum) with Facebook. This agreement specifies which data processing operations we or Facebook are responsible for when you visit our Facebook page. 2.2 Data processing by Google
Laws protecting user privacy such as the European Economic Area’s General Data Protection Regulation and other privacy laws that establish various rights for applicable US-state residents impact content publishers, application developers, website visitors, and application users. See also the Google privacy policy and Google’s site for customers and partners. Currently such regulations apply to specific geographic regions, but publishers and application developers often implement controls that affect the experience of users in all regions.
2.2.1 Data collection
Google customers use tags on web pages and an SDK for mobile apps to enable Google measurement products. The measurement data collected helps customers understand their users’ needs and, optionally, personalize the user experience and offer relevant advertising (see Advertising personalization).
Google tags and the SDK use cookies and app instance IDs, respectively, to measure user interaction. While these identifiers provide information about user behavior, Google prohibits customers from sending Personally Identifiable Information to Google Analytics. Even so, use of cookies and app IDs falls under the privacy laws mentioned previously. Google customers need to inform users about the information being stored and give them the opportunity to grant or deny their consent.
